  1. Program certification

We are pleased to announce that we have received our official EFILE certification from the Canada Revenue Agency (CRA) for forms related to capital gains.

This certification demonstrates our commitment to providing you with efficient, accurate, and CRA-approved tax filing services for all your capital gains transactions.

  2. Known issue fixed in version 28.13

    1. Auto-fill my return CRA's service passing the wrong amount for variable "B" of the annual FHSA limit for 2023

  3. Quebec Tax Data Download

Starting in version 28.13, if your client has too many RL-18 slips (available for download in 2024 and subsequent tax years), you will receive a warning telling you that they must be entered manually (the size of data exceeds DT Max's storage capacity).

In such cases, DT Max will save the RL-18 slip data to an external CSV file and include a link to that file in a keyword in the TDD-RLSLIP keyword group. This file can be opened using any spreadsheet software (e.g., Excel or Google Sheets). You can simply enter the total amounts that you have calculated using this spreadsheet in DT Max.

For full details on the RL-18 CSV file, please consult the "Many RL-18 slips" section of the document Procedure to download tax data from Revenu Québec.

For more information on Revenu Québec's Tax Data Download service, please consult the Quebec Tax Data Download document, available in our knowledge base.

  1. Mandatory efiling criteria - Reminder

For federal slip types filed after 2023, the Canada Revenue Agency (CRA) introduced a reduction in the mandatory electronic filing threshold, from 50 (fifty) to 5 (five). If, for example, a preparer was to paper file 6 (six) or more T3 slips with the trust return, then that preparer could be imposed a penalty by the CRA.

In addition, starting in 2024, tax preparers who file more than 5 (five) federal trust returns must file them electronically.

Revenu Québec has mandated the same requirement with respect to RL slips. As of January 1, 2024, if you have to file more than 5 (five) RL-16 slips, you must file them online in an XML file.

To file RL-16 slips online (in an XML file), you must have a transmitter number (the letters NP followed by six digits). If you do not have a transmitter number, you must complete and send Revenu Québec the Transmitter Registration Form (ED-430-V) to get one.

  2. T3 EFILE approval and T3 EFILE production date

DT Max T3 has been approved by the Canada Revenue Agency for EFILE purposes.

Please be sure to update your DT Max T3 program and recalculate your files prior to attempting an efile transmission.

A recalculation ensures you are transmitting under an efile approved version.

It also allows the Canada Revenue Agency's system to process the return under the correct version.

The service will accept T3 EFILE Trust returns for taxation years 2021, 2022, 2023, 2024, and 2025.

The RL-16 slip can also be transmitted at this time provided box A for Capital gains has not been completed.

  3. Message from CRA: Trusts with a capital disposition

The Department of Finance has announced that it will introduce legislation in Parliament in due course, related to the capital gains inclusion rate change with a new effective date of January 1, 2026. As a result, the CRA has reverted to administering the currently enacted capital gains inclusion rate of one-half. This means that all capital gains realized before January 1, 2026, will be subject to the currently enacted inclusion rate of one-half, unless an exemption applies.

With the proposed change to the effective date, the CRA has now reverted the forms posted online to the currently enacted rate.

The CRA will grant relief in respect of late-filing penalties and arrears interest until May 1, 2025, for impacted trust filers to provide additional time for taxpayers reporting capital dispositions to meet their tax filing obligations. This relief applies to both the filing of T3 information returns (slips) and the T3 return. Find out more: Update on the Canada Revenue Agency's administration of the proposed capital gains taxation changes.

Revenu Québec also confirmed that if you are reporting a taxable capital gain (or a net capital loss), the deadline is extended to May 1, 2025.

  4. EFILE setup

    1. Federal

Starting in January of 2025, the Canada Revenue Agency transmitter number, which always consisted of MM followed by six numeric entries (i.e. MM123456), has been revised.

For federal electronic filing purposes, the transmission of T3 slips will now require the entry of your business number, your RepID, or your trust account number (provided you are filing your own slips).

DT Max will continue to default the method of transmission to Internet file transfer (where an account number and web access code is required for filing). We strongly recommend transmitting under our default option.

Your business number will consist of nine numeric characters or fifteen alphanumeric characters.

Both your business number and Rep ID can be specified within Preferences > Tax Preparer Identification > Identification numbers.

To obtain a new Canada Revenue Agency account number please call Business Enquiries (1-800-959-5525) or refer to Business Registration Online.

Business Registration Online - What you can do - Canada.ca

Once entered, please save your changes and perform a recalculation of all applicable files.

Please note that due to this new Canada Revenue Agency requirement we will no longer support T3 electronic transmissions prior to 2021.

For 2021, 2022, and 2023 we will only support the electronic transmission of the T3 return. We will not support the electronic transmission of T3 slips.

    2. Revenu Québec reminder

For efile purposes, the RL-16 sequential number range is assigned by Revenu Québec.

It is entered by the preparer within the Quebec RL-16 EFILE setup.

This series of sequential numbers is reused every year.

If you reach the end of your range, you must complete the Transmitter Registration Form (ED-430) and increase the estimated quantity of slips.

You must specify your newly assigned efile range within the Quebec RL-16 EFILE setup.

The new sequential numbers will then be automatically applied by the DT Max T3 software.

If a new sequential number is not automatically applied then re-select the option "Quebec", within the keyword Residence , for each beneficiary in question.

Do not enter your own randomly created efile sequential number.

  5. Program certification

DT Max T3 is certified under the following authorization numbers:

  6. Version highlights

    1. Paper and electronic filing of the trust income tax return

On January 31, 2025, the Department of Finance announced a change to the effective date for the capital gains inclusion rate increase from June 25, 2024, to January 1, 2026. Following this announcement, the CRA and Revenu Québec have republished forms relating to capital gains leaving software developers little time to implement the changes and then proceed with the certification of the product.

DT Max T3 version 28.13 supports the electronic and paper filing of all federal returns including those reporting capital gains.

As for Quebec, a watermark stating "Preview - Do not send to RQ" has been stamped on all forms relating to capital gains and should not be submitted to Revenu Québec until we are fully certified. All other returns not affected by capital gains can use this version of the program to submit their TP-646 and related forms.

    2. Capital gains and losses

For the 2024 tax year the CRA will continue to administer the capital gains rate of one half. To note, however, if the trust had a disposition of qualified farm or fishing property (QFFP), or qualified small business corporation shares (QSBCS) in 2024 you must report the disposition before June 25, 2024 (Period 1) or after June 24, 2024 (Period 2) in the fields provided. This is necessary to support the increase to the lifetime capital gains exemption (LCGE) limit to $1.25 million, effective June 25, 2024, which is available to individuals. Separate reporting for Period 1 and Period 2 may also be necessary if you received a tax slip reporting dispositions in Period 1 and Period 2.

    3. Tax on equity repurchases

A 2% tax has been introduced to apply on the net value of all types of share repurchases for transactions that occur after 2023. This will apply to real estate investment trusts (REIT), specified investment flow-through (SIFT) trusts, and publicly traded entities that would be SIFT trusts if their assets were located in Canada.

The tax will not apply to an entity if the total fair market value of equity that is redeemed, acquired or cancelled in the tax year is less than $1 million.

    4. Alternative minimum tax

      Federal

Bill C-69 received royal assent on June 20, 2024, implementing significant revisions to the alternative minimum tax (AMT) regime for taxation years after 2023. Under the new rules, the basic exemption amount is now based on the fourth federal tax bracket, $1,173,206, which will be indexed annually. There are also considerable changes to the calculation of adjusted taxable income.

The legislation has introduced changes that apply specifically to trusts:

      • The basic exemption has been extended to qualified disability trusts (QDT). However, only QDT's can claim the exemption.

      • Certain types of trusts have become exempt from AMT, most notably the graduated rate estates, employee ownership trusts and trusts that are exempt from tax under Part I.

      Quebec

As of 2024, the rate applicable to the calculation of the alternative minimum tax (AMT) is 19%, i.e. the rate applicable to the second taxable income bracket of the personal income tax table.

In addition, as of this year, a graduated rate estate (GRE) is no longer subject to the AMT. In addition, the basic exemption amount, which now applies only to a qualifying disability trust (QDT), increases from $40,000 to $175,000 (this amount will be indexed starting in 2025). Note that an employee ownership trust (EOT) is not subject to the AMT.

Finally, other changes have been made to certain rates and amounts taken into account in calculating the AMT, including the inclusion rate for capital gains, the amount of the deduction for carrying charges and interest expenses in respect of an amount borrowed to earn income from property, and the amount of the tax credit for donations and gifts.

    5. New Schedule A.1, Election for Certain Trusts Regarding Taxable Capital Gains

For the year 2024, a trust other than a personal trust may file Schedule A.1 (instead of Schedule A) to report its capital gains (or losses).

    6. New Quebec form for reporting cryptoasset ownership and transactions

Starting in 2024, a trust must complete the Cryptoasset Return (TP-21.4.39) form to report ownership and transactions related to cryptoassets and attach it to its tax return, including when it owns, acquires, disposes of or uses one or more cryptoassets during the year.
